Vehicle Recovery Service - Roadside Rescue Louth
1. Contract Formation
By requesting, booking, or accepting services via phone, message, website, or verbal instruction, you confirm that you have read, understood, and accepted these Terms and Conditions.
2. Payment & Right to Refuse Service
A call-out fee applies to all services unless otherwise agreed in writing prior to attendance.
Full payment is due immediately upon completion of the service.
We reserve the right to refuse, suspend, or withdraw services where payment is not agreed or secured.
We retain a lien over any vehicle until full payment is received in cleared funds.
Right to Refuse Service
We reserve the right to refuse, suspend, or terminate service where a customer is abusive, threatening, intoxicated, or where the situation poses a risk to the safety of our staff, the customer, or the public.
3. Authority to Act
You confirm that you are the legal owner of the vehicle or are acting with full authority of the owner.
You agree to indemnify and hold us harmless against any claims, losses, or damages arising from unauthorised or fraudulent instruction to recover a vehicle.
4. Vehicle Condition & Disclosure
You must disclose all known defects, damage, modifications, or mechanical issues that may affect recovery or transport.
We accept no responsibility for pre-existing, hidden, or undisclosed defects or damage.
5. Recovery, Loading & Transport
All recovery, loading, securing, transport, and unloading operations are carried out with reasonable care and skill in accordance with standard industry practice.
The customer acknowledges that vehicle recovery involves inherent risk, particularly where vehicles are damaged, immobilised, modified, or non-roadworthy.
Except where proven negligence is established, we shall not be liable for any damage arising from inherent risks associated with recovery operations.
6. Liability
To the fullest extent permitted by Irish law, we shall not be liable for any indirect, incidental, or consequential losses, including but not limited to loss of earnings, storage fees, replacement transport, or downtime.
Our total liability for any claim shall be limited to the cost of the service provided, except where such limitation is not permitted by law.
Nothing in these Terms excludes liability for death or personal injury caused by proven negligence, fraud, or any liability that cannot legally be excluded.
7. Damage Reporting
Any damage must be reported immediately upon delivery and before the vehicle is moved from the drop-off location.
Claims made after the vehicle has been removed from our control may not be accepted unless supported by clear and verifiable evidence.
8. Third-Party Bookings
We are not responsible for disputes arising from bookings made by third parties without proper authority.
The customer agrees to indemnify us against any resulting claims, losses, or damages.
9. Additional Charges
Additional charges may apply for, including but not limited to:
- Extra mileage beyond agreed distance
- After-hours recovery
- Motorway incidents
- Winching or specialist recovery
- Difficult or restricted access
Where reasonably possible, such charges will be communicated prior to completion of the service.
10. Governing Law
These Terms and Conditions are governed by the laws of Ireland and subject to the exclusive jurisdiction of the Irish courts.
